WHAT IS ADJUDICATION:
A party who enters into a 'construction contract' has a statutory right to refer a dispute under that contract to adjudication.
The Adjudicator who is nominated or appointed will reach a decision on the dispute that is referred, which has temporary binding effect on both parties, and if necessary the decision can be enforced through the courts.
APPOINTING AN ADJUDICATOR
Andrew Essam has been acting as a construction adjudicator since 2001. He has been nominated by CIC, CIArb, AICA and RICS to act as the Adjudicator in over 100 construction adjudications.
He has decided disputes in connection with interim payments or final accounts concerning the valuation of variations, loss and expense, extensions of time, liquidated damages and defective works. The disputes have arisen under various contracts including a range of standard JCT contracts, NEC contracts and bespoke contracts.
The adjudications have arisen between all parties within the industry; Sub-Contractor and Main Contractor, Sub-Sub-Contractor and Sub-Contractor, Main Contractor and Employer and also Consultant and Contractor with sums in dispute ranging in value from £10k to over £1M.
